1. What is illegal employment

Illegal employment of foreigners refers to the situation where foreigners working in China engage in work without obtaining a legal employment permit and in violation of Chinese laws and regulations.

. What situations belong to illegal employment
The criteria for identifying illegal employment by foreigners mainly include the following aspects:

(1) Work within China without obtaining a work permit and work-related residence permit in accordance with regulations.

(2) Working within China beyond the scope of the work permit.

(3) Foreign students who violate the regulations on work study programs and exceed the prescribed job scope or time limit are working within China.

In addition, according to the relevant provisions of the Exit and Entry Administration Law of the People's Republic of China, units that illegally employ foreigners and individuals or units that introduce foreigners to illegal employment will also face certain legal responsibilities and penalties.

 

2. Punishment for illegal employment

According to Article 80 of the Exit and Entry Administration Law of the People's Republic of China:

(1) Foreigners who engage in illegal employment shall be fined not less than 5000 yuan but not more than 20000 yuan; Those with serious circumstances shall be detained for not less than five days but not more than fifteen days and fined not less than 5000 yuan but not more than 20000 yuan.

(2) Individuals who introduce foreigners for illegal employment shall be fined 5000 yuan per illegal introduction, with a total amount not exceeding 50000 yuan; Impose a fine of 5000 yuan on the unit for each illegal introduction of a person, with a total amount not exceeding 100000 yuan; Any illegal gains shall be confiscated.

(3) Those who illegally hire foreigners shall be fined 10000 yuan for each illegal employment, with a total amount not exceeding 100000 yuan; Any illegal gains shall be confiscated.

In addition, Article 62 of the law stipulates that foreigners who engage in illegal employment may be deported out of the country if the circumstances are serious. Personnel who are deported out of the country are not allowed to enter the country for one to five years from the date of deportation.

With the more standardized and transparent management of foreign work in China by the government, the experiences of foreigners in China and the recruitment of foreigners by employers will be recorded. Therefore, bad records may continue to be recorded in the public security system. The aforementioned illegal and non-standard behaviors will have a negative impact on the credit of foreign nationals and employers.

 


一、什么是非法就业
外国人非法就业是指在中国工作的外国人没有得到合法的就业许可,违反了中国法律规定的情况下从事工作。

 

二、哪些情况属于非法就业
外国人非法就业的认定标准主要包括以下几个方面:

(1)未按照规定取得工作许可和工作类居留证件在中国境内工作。

(2)超出工作许可限定范围在中国境内工作。

(3)外国留学生违反勤工助学管理规定,超出规定的岗位范围或者时限在中国境内工作。

此外,根据《中华人民共和国出境入境管理法》的相关规定,非法雇佣外国人的单位,介绍外国人非法就业的个人或单位,也都会面临一定的法律责任和处罚。

 

三、非法就业的处罚
根据《中华人民共和国出境入境管理法》第八十条规定:
(1) 外国人非法就业的,处五千元以上二万元以下罚款;情节严重的,处五日以上十五日以下拘留,并处五千元以上二万元以下罚款。
(2) 介绍外国人非法就业的,对个人处每非法介绍一人五千元,总额不超过五万元的罚款;对单位处每非法介绍一人五千元,总额不超过十万元的罚款;有违法所得的,没收违法所得。
(3) 非法聘用外国人的,处每非法聘用一人一万元,总额不超过十万元的罚款;有违法所得的,没收违法所得。


此外,该法第六十二条规定,外国人有非法就业情形的,情节严重可以遣送出境,被遣送出境的人员,在被遣送出境之日起一至五年内不准入境。

 

随着国家对外国人来华工作的管理更加规范、透明,外国人在华经历、用人单位招用外国人的情况都会被记录,因此不良记录可能会一直被记录在公安系统中,前述不合法、不规范的行为会对外国人、用人单位的信用造成不良影响。
